Terms of Service

By accessing or using Fitzpoint's website, web dashboard, or mobile app (together, the "Service"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Service.

Fitzpoint offers two account types: coach accounts created directly with Fitzpoint, and client accounts created through a coach's invitation. You must be at least 16 to hold an account. A coach inviting a client under this age is responsible for obtaining consent required by applicable law.

You're responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You're responsible for all activity under your account and must notify us immediately if you notice unauthorized use.

Coach accounts are billed through our payment provider, Paddle, based on the plan and cycle (monthly or annual) selected at sign-up. Free trials automatically convert to a paid subscription unless canceled before the trial ends.

• You can cancel anytime from account settings; cancellation takes effect at the end of the current billing period
• Fees are non-refundable except where required by law, or under our 30-day money-back guarantee for new subscriptions
• We may change pricing for existing subscribers with at least 30 days' notice

You agree not to:

• Use the Service to provide medical diagnosis, treatment, or advice you're not licensed to give
• Upload content that is unlawful, harassing, or infringes another person's rights
• Attempt unauthorized access to another user's account or data
• Reverse-engineer, scrape, or resell access to the Service without our written permission
• Use the Service in a way that disrupts its normal operation or security

You retain ownership of the programs, nutrition plans, messages, photos, and other content you upload ("Content"). By uploading Content, you grant Fitzpoint a limited license to host, store, and display it to the extent needed to operate the Service — for example, syncing a program a coach built to their client's app.

You're responsible for having rights to any Content you upload, including client consent to store progress photos and health data.

The Fitzpoint name, logo, software, and platform design belong to Fitzpoint and are protected by intellectual property law. These Terms don't grant you any rights to our trademarks or branding beyond what's needed for normal use of the Service.

Fitzpoint integrates with third-party services, including Paddle for payments, Apple Health and Google Fit for wearable data, and app store platforms for mobile distribution. Your use of these services is subject to their own terms.

Fitzpoint is a coaching and communication platform; it is not a medical device or a substitute for professional medical advice. Coaches are solely responsible for the training and nutrition guidance they provide, and clients should consult a physician before starting any new exercise or nutrition program.

To the maximum extent permitted by law, Fitzpoint is not liable for indirect, incidental, or consequential damages arising from use of the Service — including injuries arising from a coach's training or nutrition advice. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

You can stop using the Service and cancel your subscription anytime. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

These Terms are governed by the laws of the jurisdiction where Fitzpoint is established, without regard to conflict-of-law principles, unless local mandatory consumer protection law requires otherwise.

We may update these Terms from time to time. Continuing to use the Service after an update means you accept the revised Terms.
